Under ESSA, in Section 8538, otherwise called Consultation with Indian Tribes and Tribal Organizations, districts are required to consult with appointed tribal representatives in the development of district plans. This provision applies to districts that receive more than $40,000 for Title VI or have over 50 percent American Indian student enrollment.
